The Federation of the Swiss Watch Industry FH is the Swiss watch industry leading trade association, with membership of over 500 companies - representing 90% of Swiss watch producers.

The purpose of the FH is to contribute to the defence and development of the Swiss watch industry in Switzerland and abroad. The Federation has the authority to take action in order to defend the rights of its members, including the fight against the sale of counterfeits.

The FH is very concerned about the increasing market of fake watches ("replica") on the Internet and has consequently introduced special measures in its fight against counterfeited products.

Your company is certainly aware that the sale of counterfeits infringes the owners' intellectual property rights. Manufacturing, distributing, selling and advertising counterfeiting items constitute a serious violation of trademarks mentioned hereby.

In the present case, our Federation represents owners of Omega, TAG Heuer, Audemars Piguet, Hublot, Longines, Breitling, Gucci, Breguet, Richard Mille, Hermès, Patek Philippe, Franck Muller, Zenith, Oris, Graham, Chopard, Bulgari, Ulysse Nardin, Rado, Tissot, Chanel, Christian Dior brands in trademark matters. Omega, TAG Heuer, Audemars Piguet, Hublot, Longines, Breitling, Gucci, Breguet, Richard Mille, Hermès, Patek Philippe, Franck Muller, Zenith, Oris, Graham, Chopard, Bulgari, Ulysse Nardin, Rado, Tissot, Chanel, Christian Dior are registered trademarks in China, the United States, European Community and many more other countries around the world.

It has come to FH's attention that your company is leasing server space for website at http://www.*******.ru (confirmed by WHOIS records).

As the hosted content http://www.*******.ru is unequivocally unlawful, the FH demands that your company immediately take measures that lead to the content bring take offline.

The operator of this website is infringing above mentioned trademarks and on information and belief is selling counterfeit products of such said trademarks. Infringing use of the marks occurs throughout the website at http://www.*******.ru including unauthorized use of aforementioned trademarks to promote sales of look-a-like and/or counterfeit watches for sale.

The FH, as plaintiff, has been trying to communicate directly with the content provider. This attempt was unfortunately unsuccessful, due to, either the inability to identify the content provider or the lack of a proper answer.

8. Hosting company requires: The goods and/ or services covered by or offered under the mark claimed to be infringing:

The website http://www.*******.ru is offering and selling replica watches. This means that the content of the website and the website itself are illegal. For basic consumers, that could mean that your company tolerates and even accepts to be associated with such illegal activities.

None the less, it is important to note that tolerating fake products is:

- agreeing with know-how's piracy;

- supporting and financing organized crime;

- accepting underground and children's labour;

- endangering consumers' health and safety;

- contributing to reduce employment and stifling growth.

We state, signed under penalty of perjury, that:

- FH is an agent authorized to act on behalf of the owner, of certain intellectual property rights ("IP Owner") (trademarks, design and patent rights);
