Прошу оставить свое мнение по следующей ситуации:

22 октября на Sedo.com проводился аукцион по доменам. Я участвовал в торгах по одному из лотов. По лоту в последние минуты шла упорная борьба, хотя я четко дал понять самому активному биддеру, что я его перебью. В конце концов он сдался, хотя в последнюю минуту ставка пришла еще от одного биддера, но ее перекрыла моя авто ставка. Лот был с reserve price, моя ставка ее перекрывает с лихвой.

Sedo в этот же день за 5 минут до закрытия аукциона начали ддосить. (Хотя я думал, что это из-за аукционов и большой нагрузки).

Это сказалось на закрытии аукциона. Хотя я и испытывал проблемы с доступом, но изрядно мучив рефреш все таки попадал на сайт. Я увидел, что выиграл свой лот и пытался посмотреть как закончились другие торги, но к этому времени Sedo окончательно лег и вместо страницы аукциона было вывешено сообщение, что аукцион по .de доменам, который проходил в это же время будет продлен до 8 вечера. Про обычные аукционы ничего не было сказано.

Позже появилось несколько заявлений, но все их объединяет последнее:

"Sedo would like to take this chance to provide more information regarding the distributed denial of service (DDOS) attack that intended to disrupt our services yesterday, including the conclusion of our monthly auction at GreatDomains.com and the 1, 2, & 3-Character .de Pre-Auction. While the Sedo and GreatDomains websites were slowed as the auction was closing, our bid logs show that we did not experience any downtime until a brief window of time after the close of the final domain being sold in the GreatDomains auction. Bids were still being received throughout the close of the auction and every domain receiving bids in the final minutes were extended in accordance with our auction rules. Throughout the auction, the number of bids received were high and consistent, and in the end, this GreatDomains auction resulted in higher than average bids and sales volume, easily beating the results from our September auction. Because every domain that would have been extended due to bidding activity were in fact extended, there was no cause or reason for any further extensions of the auction timeframe.

Sedo has invested heavily to build a robust infrastructure that can handle high traffic, even during multiple auction events, and were it not for a malicious attack on our servers by those attempting to disrupt our services, pages would have loaded as fast as normal. Due to our proactive measures to implement a response system for such attacks, the DDOS queries were quickly routed away from our servers and the site no longer experienced any delays. While we regret that some of our users experienced a slow response rate from our website, we are encouraged that even during an extreme event we concluded another successful GreatDomains auction."

Теперь продавец пытается аннулировать сделку, ссылаясь на то, что Sedo не обеспечила нормального аукциона.

Покопался в термсах и нашел вот это:

5.1.2.7. Liability

Sedo in no way guarantees or further warrants that the web page on which bids can be placed (“Bidding Page”) during the Auction Period is permanently accessible. If a Bidding Page is not accessible, the Seller may not, in the future, refer to a potentially higher bid during this time period as a mechanism for not following through with a sale. Furthermore, a potential bidder may not argue, for the same purposes, that he would have been the highest bidder for the Domain Auction if the webpage would have been available.

With regards to auctions other than Sedo’s standard marketplace triggered auctions, such as broker assisted auctions, promotional auctions, or auctions held at affiliate websites like GreatDomains.com, in the case of technical issues which may occur within Sedo’s servers, networks, or other mechanisms, Sedo may, to the extent they are within Sedo’s control, take actions reasonably necessary to remedy such issues as they occur. Such actions include, but are not limited to, extending the length of time the auction is active and/or canceling such auctions.

еще в термсах есть пункт о резерв цене. Суть его в том, что если резерв достигнут, то селлер обязан продать домен.

Прав ли я требуя завершения сделки? т.к. считаю, что термсы и заявление седо на моей стороне.
