XXXX, a corporation based in XXXXX, has requested our law firm to
safeguard its legal interests in the following matter:
You are registrant and administrative contact of the domain names XXXX-modelX.com and
XXXX-modelX.com. The websites under the domain names are offline at this time.
Our client is the owner of the world famous name and mark “XXXX”. Inter alia our client
has registered the following trademarks:

Your identical use of our client?s trademark (“XXXX”) in a domain name constitutes an
infringement of the worldwide recognized rights of our client.
Your use of our client?s trademarks and name in your domain names is likely to cause
confusion with our client?s enterprises. This likelihood of confusion is intensified by
the addition of the suffixes “modelX” and “modelX”. Since our client established a series of
models named “modelA”, “modelB” and “modelC” the relevant members of the public will relate the
domain name to our client.
You are thus infringing our client’s rights deriving from its trademarks and names. You
are under obligation in particular to observe a prohibition, to pay compensation for
any losses or damage caused by the aforementioned facts at any past or future date
and to furnish relevant information.
In view of the infringement already committed, there is good cause to assume the risk
of repetition. The only way of dispelling this assumption is to issue a negative
covenant carrying a penalty; merely discontinuing the act of infringement is not
sufficient.
We therefore call on you to issue a cease-and-desist declaration to us and to initiate
the transfer of the domain names to our client by
November 28, 2011.
In view of the necessity for our intervention and your liability to pay compensation,
you also owe the costs incurred by our client having to request our services.
Our client offers not to pursue further claims against you, if you comply in due time
with the demands specified above. Otherwise, we shall advise our client to take the
matter to court or alternative dispute resolution without further notice.
