Dear xxxxxxxxx,

Written and sent on behalf of Booking.com B.V. (part of the Priceline Group).

Your affiliate account has been identified during our business processes and quality procedures as having an abnormally high percentage of fraudulent bookings*.

After thorough consideration and consultation with our legal and security teams, and due to the negative business impact these reservations have upon Booking.com B.V., the Priceline Group and our hotel partners, we regretfully inform you of our decision to terminate the affiliate agreement between Booking.com B.V. and xxxxxxxxx, effective immediately.

Any visitors or business derived is the responsibility of xxxxxxxxx and has been found in breach of the Affiliate Agreement.

The result of this termination notice includes:
- Disabled access to your account (including but not limited to: Partner Centre, Credit Slips, Extranet, XML and any other related affiliate tooling)
- Removal of the function of all Booking.com affiliate page(s) (including all affiliate ids within your partnership)
- Any outstanding commission payments

Regarding the latter, please find clause 2.1.1 (iii) from the Affiliate Agreement:
iii) In the event of (alleged) fraudulent activities by the Partner (or parties related to or using the Service through the Partner) or insofar required by law, court order, (semi) governmental instruction or orders, arbitrational decision (or similar ruling), or subpoena, Booking.com reserves the right to suspend its (payment) obligations under the Agreement (including pay out of any (kickback) fee, commission, or other amount to the Partner or any third party), and any (pre)paid amount under or related to (fraudulent) activities will be repaid within 14 days upon first request of Booking.com).

Should xxxxxxxxx wish to challenge this decision please contact us by email and include for review:
- Full and complete disclosure of your traffic sources, business model, website(s) responsible for delivering visitors to the Booking.com affiliate ids during the past 3 months.
- Any other information related to this issue that can be considered as positive regarding the issue at hand.


*Fraudulent bookings are considered as non-guest cancellations. A non-guest cancellation can be initiated by the booked hotel (invalid credit card or no-show) or have been reported as fraudulent.
